TERMS OF SERVICE

(1)  Diagnostics and Repairs: The PC-EMT LLC will attempt to diagnose your desktop or laptop computer and/or other computer related equipment problem, provide an estimate of applicable service fees (plus parts if required), and then provide you with a repair solution. In certain cases, however, diagnosis and support may not be completed because of a problem with your computer or its configuration that is beyond our control.

(2)  Your Responsibility: While The PC-EMT LLC will make all reasonable efforts to safeguard the contents (data) stored on your computer, you understand and agree that prior to contacting or allowing The PC-EMT LLC to perform diagnostic, repair, or other services on your computer, it is your responsibility to back-up the data, software, information or other files stored on your computer disks and/or drives if you so desire. You acknowledge and agree that The PC-EMT LLC and/or its third-party service provider shall not be responsible under any circumstances for any loss, alteration, or corruption of any software, data, or files.

(3)  Service Fees: You acknowledge that the labor rates published on The PC-EMT LLC web site apply to each repair component do not include the cost of parts. If The PC-EMT LLC is successful in providing a repair solution you understand that the minimum labor/service fee is $35.00 in-house and $45.00 on-site. You further acknowledge and agree that The PC-EMT LLC will provide free diagnostic testing of your laptop computer and/or other computer related equipment only if you agree to complete the recommended service at the price quoted. In the event that you should decline quoted service you agree to pay a service fee in the amount of $35.00/$45.00 plus pickup and return shipping charges when applicable. You agree to contact and discuss service options with The PC-EMT LLC within 45 days from the date we receive your desktop/laptop. Once you provide verbal or electronic approval of service fees you agree to make payment for these fees within 30 days of the service completion date. If you later decline service you previously approved you agree to pay 100% of labor fees associated with this service plus a 20% restocking fee for any and all parts used to facilitate the repair. If The PC-EMT LLC is unable to reach you via telephone or email within 30 days of the service completion date or within 45 days from the date we receive your laptop we will notify you via U.S. certified mail. The PC-EMT LLC accepts no responsibility for any unclaimed goods left in our facility for which service fees are due and have not been paid within 30 days after The PC-EMT LLC obtains a receipt indicating delivery or attempted delivery of the certified letter was made. I agree that The PC-EMT LLC may dispose of any unclaimed goods and hereby release The PC-EMT LLC and waive any claims regarding such disposal.

(4)  Repair Turnaround Times: The turnaround times published on the The PC-EMT LLC web site do not include shipping time in transit and reflect only actual time in shop. Turnaround time also depends on availability of parts. If required parts are not in stock the turnaround time will not start until parts become available.

(5)  Your Responsibility Regarding Shipping: (1) Initial desktop/laptop shipment from you to The PC-EMT LLC: It is very important that you properly package your desktop/laptop prior to shipment to us. You further agree that damages that may occur during shipping will be sole responsibility of the shipping carrier and that The PC-EMT LLC is not responsible for such damages. (2) Final shipment from The PC-EMT LLC to you: Upon receipt of returned items from The PC-EMT LLC you are responsible for inspecting and noting obvious damages to the package exterior to the UPS delivery person at the time you accept the package. You must accept the package before you can make a damage claim with UPS. Where shipped items have received damages internally, you are responsible for reporting this damage to The PC-EMT LLC with 24-48 hours after receiving the package at which time we will advise you on UPS damage claim procedures. IMPORTANT: You must keep all packaging materials and have them ready for pickup and inspection by a UPS representative. DO NOT RETURN DAMAGED MERCHANDISE to The PC-EMT LLC, UPS must first validate the damage claim. UPS damage claim procedures can be found on the UPS web site at www.ups.com/content/us/en/resources/service/claims/hlp/damage_process.html.

(f)  Canceled Orders and Refund Policy: (1) Return of service parts: All parts purchased and used to facilitate service that you authorize are non-refundable. If the parts are defective in any way and a warranty is included with these parts The PC-EMT LLC will instead replace or repair the part as specified in the warranty agreement for that part. (2) Return of general merchandise: If you wish to return merchandise purchased from The PC-EMT LLC that was not used to facilitate service on your computer, such as external accessories, etc, you agree to pay a 20% restocking fee. You further agree that any shipping and handling charges you paid for this merchandise are non-refundable and that return shipping charges are solely your responsibility.

SERVICE LIMITATIONS; LIABILITY

(a)  LIMITATIONS TO SERVICE: The PC-EMT LLC RESERVES THE RIGHT TO REFRAIN FROM PROVIDING ANY OR ALL REQUESTED SERVICES AND INSTEAD REFUND YOUR PAYMENT, WHOLLY OR IN PART, ON THE BASIS THAT YOUR TECHNICAL NEEDS OR OTHER REQUIREMENTS ARE UNUSUAL OR EXTENSIVE AND BEYOND THE SCOPE OF THIS SERVICE AGREEMENT AS REASONABLY DETERMINED BY The PC-EMT LLC.

(b)  If The PC-EMT LLC’s ability to render desktop/laptop repair services is impaired by you or circumstances beyond the control of The PC-EMT LLC, The PC-EMT LLC may choose not to provide or to discontinue services.

(c)  LIMITATION OF LIABILITY: To the extent permitted by law, you agree that The PC-EMT LLC’s total liability for damages related to its services is limited to the total amount you pay for the these services (plus parts if applicable), and you release The PC-EMT LLC from liability for any indirect, incidental, special, or consequential damages. The PC-EMT LLC IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR FOR YOUR INABILITY TO USE YOUR COMPUTER EQUIPMENT OR OTHER PRODUCT.

(d)  LIMITATION OF LIABILITY DURING SHIPPING: The PC-EMT LLC uses UPS as a reliable shipping carrier and in most cases provides between $500 and $1000 of shipping insurance for each shipment. The PC-EMT LLC is not responsible for damages that occur during shipping; however damages should be processed using the procedures set forth by UPS located at www.ups.com/content/us/en/resources/service/claims/hlp/damage_process.html. The PC-EMT LLC will provide UPS damage claim assistance provided you follow the damage claim procedures outlined in the terms of service section (e) above.

SERVICE WARRANTY

   Upon completion of service every laptop will undergo a thorough quality assurance check prior to shipping to ensure minimal defects. In the unlikely event that you should encounter problems associated with the service that was performed on your desktop or laptop you agree to contact The PC-EMT LLC within 7 days. A support representative will attempt to correct the problem via telephone or email, however if this is unsuccessful the representative may authorize the return of the laptop for a free follow up diagnostic service. You agree to pay all upfront shipping charges associated with returning the laptop to The PC-EMT LLC, however if the problem is reported within 7 days from the date you initially received your laptop back, and the problem is found to be covered under our warranty policy, you may request to have these shipping charges credited to your account with a maximum credit of $18.00. You agree that shipping charges for any warranty service provided past 7 days from the date you received your laptop will be solely your responsibility.
